Impact Fees - Effective April 1st 2025

Nov 26th, 2024 rate ordinance 6023 was passed. An ordinance to enact water and wastewater development impact fees, adopting rules and regulations related thereto, pursuant to Ark. Code Ann. §14-56-103; and amending chapter 118 of the code of ordinances of the city of Springdale, Arkansas.

Summary of Impact Fee Deployment:

On November 26, 2024, City Council approved ordinance number 6023 which enacted impact fees for the first time in the City of Springdale and its service area. Impact fees go into effect on 4/1/2025. Below is a summary of scenarios where impact fees may or may not be necessary. Impact fees below exclude any construction tap fees, deposits, and other fees that may be required in some instances.

Ordinance No. 6023

“Sec. 118-226. Effective Date/Application.

            The provisions of this section shall be effective April 1, 2025. Provided, however, that any Preliminary Plat, Large Scale Development approved by the Springdale Planning Commission pursuant to Chapter 112 of the Code of Ordinances of the City of Springdale, Arkansas, and approved by Springdale Water Utilities prior to the effective date shall be exempt from the development impact fees set forth herein.”

Types of Services:

Residential/Commercial: Potable water service which feeds either a household or a commercial facility including industrial facilities. This type of services includes potable water and sanitary sewer services, if applicable.

Irrigation (also known as a seasonal): Non-potable water service which feeds landscaping or outdoor use, traditionally at a home feeding irrigation system and landscaping. These services are coupled with a residential or commercial service above. This type of service does not include sanitary sewer services.

Pasture: Stand-alone non-residential/commercial potable water service which may feed landscaping, agricultural, or other outdoor uses. These services have no association with a residential or commercial service above. This type of service does not include sanitary sewer services.

Definitions of approval:

Springdale Water Utilities approval means a written approval of plans and specifications for the construction of water and/or sewer facilities. Written approval is issued to the engineer of record, on behalf of the developer or builder, upon acceptance of designs of proposed improvements.

City of Springdale approval means approved preliminary plat, large scale development or non-large scale development approved by the Springdale Planning Commission pursuant to Chapter 112 of the Code of Ordinances of the City of Springdale.

All new construction and major renovation projects approved by city planning & SWU prior to 4/1/2025 (large scale or non-large scale) approvals are valid for a maximum of one year in all scenarios, all expired approvals will go through a reapproval process and will be subject to impact fees.

All approved new construction and major renovation projects described above are only subject to meter upsizing impact fees (Example: going from 5/8-inch to 1-inch would require the difference in fees between the two different meter sizes).

All existing accounts are eligible for one 5/8-inch “cut in” seasonal without impact fees, larger sizes would require upsizing fees similar to the above example.

Above upsizing impact fees are paid prior to issuance of building permit or initiation of service.

All new construction and major renovation projects approved by city planning & SWU after 4/1/2025 – subject to impact fees (large scale)

Fees are paid prior to issuance of building permit.

All residential/commercial services eligible for one 5/8-inch irrigation without additional impact fees.

Pasture meters are subject to impact fees according to their size and paid prior to the initiation of service.

All are subject to upsizing impact fees paid prior to issuance of building permit or initiation of service.

New service requests on new construction or major renovation after 4/1/2025- subject to impact fees (non-large scale)

Fees are paid prior to issuance of building permit.

All residential/commercial services eligible for one 5/8-inch irrigation without additional impact fees.

Pasture meters are subject to impact fees according to their size and paid prior to the initiation of service.

All are subject to upsizing impact fees paid prior to issuance of building permit or initiation of service.

All undeveloped or vacated inactive services – Undeveloped property or property without habitable, commercial, or industrial structures that have been inactive or vacated for a period greater than 1 year are subject to impact fees. Habitable, commercial, and industrial structures are defined as those properties with a valid certificate of occupancy. Extensions to one year time requirement may be granted if requested prior to expiration of initial one year period.

Reduction of meter sizes are not eligible for reimbursement of previously paid impact fees.
